Interpretation and Definitions

Interpretation

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

For the purposes of this Privacy Policy:

• Account means a unique account created for You to access our Service or parts of our Service.
• Business, for the purpose of the CCPA (California Consumer Privacy Act), refers to the Company as the legal entity that collects Consumers’ personal information and determines the purposes and means of the processing of Consumers’ personal information, or on behalf of which such information is collected and that alone, or jointly with others, determines the purposes and means of the processing of consumers’ personal information, that does business in the State of California.
• Company (referred to as either “the Company”, “We,” “Us” or “Our” in this Agreement) refers to Sevenstar Academy, LLC, 539 W. Commerce Street, Suite 4180, Dallas, TX 75208, operating the Sevenstar Academy International Diploma Programme. For the purpose of the GDPR, the Company is the Data Controller.
• Consumer, for the purpose of the CCPA (California Consumer Privacy Act), means a natural person who is a California resident. A resident, as defined in the law, includes (1) every individual who is in the USA for other than a temporary or transitory purpose, and (2) every individual who is domiciled in the USA who is outside the USA for a temporary or transitory purpose.
• Cookies are small files that are placed on Your computer, mobile device or any other device by a website, containing the details of Your browsing history on that website among its many uses.
• Country refers to: Texas, United States
• Data Controller, for the purposes of the GDPR (General Data Protection Regulation), refers to the Company as the legal person which alone or jointly with others determines the purposes and means of the processing of Personal Data.
• Device means any device that can access the Service such as a computer, a cellphone or a digital tablet.
• Do Not Track (DNT) is a concept that has been promoted by US regulatory authorities, in particular the U.S. Federal Trade Commission (FTC), for the Internet industry to develop and implement a mechanism for allowing internet users to control the tracking of their online activities across websites.
• Facebook Fan Page is a public profile named Sevenstar Academy created by the Company on the Facebook social network, accessible from https://www.facebook.com/sevenstaracademy
• Personal Data is any information that relates to an identified or identifiable individual. For the purposes for GDPR, Personal Data means any information relating to You such as a name, an identification number, location data, online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity. For the purposes of the CCPA, Personal Data means any information that identifies, relates to, describes or is capable of being associated with, or could reasonably be linked, directly or indirectly, with You.
• Sale, for the purpose of the CCPA (California Consumer Privacy Act), means selling, renting, releasing, disclosing, disseminating, making available, transferring, or otherwise communicating orally, in writing, or by electronic or other means, a Consumer’s personal information to another business or a third party for monetary or other valuable consideration.
• Service refers to the Website, our educational and programme-related platforms, and our systems.
• Service Provider means any natural or legal person who processes the data on behalf of the Company. It refers to third-party companies or individuals employed by the Company to facilitate the Service, to provide the Service on behalf of the Company, to perform services related to the Service or to assist the Company in analyzing how the Service is used. For the purpose of the GDPR, Service Providers are considered Data Processors.
• Third-party Social Media Service refers to any website or any social network website through which a User can log in or create an account to use the Service.
• Usage Data refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).
• Website refers to the Sevenstar Academy International Diploma Programme site, accessible from www.sevenstaracademyidp.org, or other domains registered by the Company.
• You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable. Under GDPR (General Data Protection Regulation), You can be referred to as the Data Subject or as the User as you are the individual using the Service.

Personal Data

While using or inquiring about Our Service, We may ask You to provide Us with certain personally identifiable information that can be used to contact or identify You. Personally identifiable information may include, but is not limited to: email address, first name and last name, phone number, address, state, province, ZIP/postal code, city, and Usage Data.

• For other purposes: such as data analysis, identifying usage trends, determining the effectiveness of our communications, and to evaluate and improve our Service.

We may share Your personal information in the following situations:

• With Service Providers: to monitor and analyze the use of our Service, for payment processing, or to contact You.
• With Affiliates: including Our parent company and any other subsidiaries, joint venture partners, or other companies that We control or that are under common control with Us. We will require those affiliates to honor this Privacy Policy.

Retention of Your Personal Data

Analytics

We may use third-party Service Providers to monitor and analyze the use of our Service, such as Google Analytics. Google uses the data collected to track and monitor the use of our Service. We may use Your Personal Data to contact You with updates or other information that may be of interest to You. You may opt out at any time by following the unsubscribe link in any email We send or by contacting Us. Usage, Performance and Miscellaneous

We use an invisible captcha service named reCAPTCHA, operated by Google, for security purposes. Information gathered by reCAPTCHA is held in accordance with Google’s Privacy Policy: https://www.google.com/intl/en/policies/privacy/

GDPR Privacy

Legal Basis for Processing

We may process Personal Data under the following conditions: Consent; Performance of a contract; Legal obligations; Vital interests; Public interests; or Legitimate interests pursued by the Company. The Company will gladly help clarify the specific legal basis that applies to any particular processing.

Your Rights under the GDPR

You have the right, under this Privacy Policy and by law if You are within the EU, to:

• Request access to Your Personal Data, and receive a copy of the Personal Data We hold about You.
• Request correction of the Personal Data that We hold about You.

• Category K: Inferences drawn from other personal information. Collected: No.

Sources of Personal Information

We obtain these categories directly from You, indirectly from You (e.g. observing Your activity on our Service), automatically (e.g. via cookies), and from Service Providers.

Use and Disclosure for Business or Commercial Purposes

We may use or disclose personal information to operate our Service, respond to Your inquiries, fulfill the reason You provided the information, comply with law enforcement requests, for internal administrative and auditing purposes, and to detect and prevent security incidents or fraud.

In the last twelve months, We may have used or disclosed the following categories for business or commercial purposes: Category A, Category B, Category D, and Category F.

Sale of Personal Information

As defined in the CCPA, we have not sold Category A, B, D, or F personal information for monetary payment, though “sale” under CCPA is defined broadly and may include certain data-sharing arrangements with advertising or analytics partners.

Sale of Personal Information of Minors Under 16

We do not sell the personal information of Consumers We actually know are less than 16 years of age, unless We receive affirmative authorization from the Consumer (if 13–16) or their parent or guardian (if under 13). If You believe a child under 13 has provided Us with personal information without consent, please contact Us to request deletion.

Your Rights under the CCPA

• The right to notice of which categories of Personal Data are collected and why.
• The right to request disclosure of categories collected, sources, purposes, and third parties shared with.
• The right to opt out of the sale of Your personal information.
• The right to delete Your Personal Data, subject to certain legal exceptions.
• The right not to be discriminated against for exercising any of these rights.

Exercising Your CCPA Rights

Only You, or a person registered with the California Secretary of State that You authorize, may make a verifiable request. We will disclose and deliver required information free of charge within 45 days of a verifiable request (extendable once by an additional 45 days with notice). Disclosures cover the 12-month period preceding the request.

“Do Not Track” Policy as Required by CalOPPA

Our Service does not respond to Do Not Track signals. Some third-party websites do keep track of Your browsing activities; You can set Your browser preferences to inform websites that You do not want to be tracked.

Children’s Privacy

The Service may contain content appropriate for children under the age of 13. Through the Service, children under 13 may participate in activities that involve the collection or use of personal information. We use reasonable efforts to ensure that before We collect any personal information from a child, the child’s parent receives notice of and consents to our personal information practices.

We may also limit how We collect, use, and store information of Users between 13 and 18 years old. We may ask a User to verify their date of birth before collecting personal information; if the User is under 13, the Service will be blocked or redirected to a parental consent process.

Information Collected from Children Under 13

The Company may collect and store persistent identifiers such as cookies or IP addresses from children without parental consent for the purpose of supporting the internal operation of the Service. Other personal information about children — such as first and/or last name, date of birth, gender, grade level, email address, telephone number, and parent or guardian name and email — is only collected with prior parental consent or when submitted by a parent or guardian.

Your California Privacy Rights (California’s Shine the Light Law)
